Terms & Conditions

By creating an account, downloading our app, or using Friendern's services (including video/voice calls, live streams, gifts, coin purchases, and creator payouts), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use Friendern.

You must be 18+ to use Friendern. Creators must complete identity verification where required by law and by our payout partners. You are responsible for the accuracy of any information you submit.

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. We may suspend or terminate accounts for suspected fraud, policy violations, illegal activity, or risk to users.

• Coins are licensed, non-transferable, non-redeemable virtual items with no cash value (except as expressly permitted for creator redemptions).
• We may change coin pricing, bundles, or gift values at any time.
• All coin purchases are final and non-refundable to the maximum extent permitted by law.
• Taxes and/or fees may apply depending on your location and app store rules.

• Calls are billed per minute or fraction thereof using coins; live streams may include subscriptions, tips, or paid events.
• Network/data charges are your responsibility.
• Some sessions may allow recording. Where applicable, both parties must consent as required by law. If you do not consent, do not join or remain in a recorded session.

• We pay creators out of platform revenue per our then-current rates shown in-app or in creator dashboards.
• Payouts are processed via third-party providers (e.g., Stripe/Flutterwave/Paystack, Apple/Google in-app where applicable).
• Minimum thresholds, payout schedules, fees, currency conversion, KYC/AML checks, and tax forms apply.
• We may withhold, delay, offset, or claw back earnings in cases of chargeback, fraud, policy breach, or legal requirement.

• Coin purchases and gifts are non-refundable unless required by law.
• We may deduct chargebacks, payment disputes, or penalties from creator balances or future payouts.

You agree not to:

• Post, stream, or share illegal, harmful, harassing, hateful, sexually exploitative, or violent content, including content involving minors or non-consenting adults.
• Engage in doxxing, threats, impersonation, scams, spam, IP infringement, or privacy violations.
• Attempt to reverse-engineer, scrape, or abuse the platform or payments.

We may remove content and/or suspend accounts at our discretion.

• You own your content. You grant Friendern a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and adapt your content solely to operate, promote, and improve the Services.
• You represent that you have all rights and permissions to the content you upload or stream.
• You agree to follow applicable copyright/DMCA processes. We may remove material on receipt of valid notices.

• Friendern may offer AI translation, transcription, and moderation. These features can make errors and are provided "as is" for convenience only.
• Where permitted by law and by your settings, audio/text may be processed to provide translations, captions, or safety checks.

• Friendern does not provide medical, legal, tax, or financial advice.
• You are solely responsible for your interactions. Use caution and common sense, especially in private calls or off-platform arrangements.

Payment processors, analytics, crash reporting, content delivery, and identity verification are provided by third parties under their own terms and policies. We are not responsible for third-party failures.

We may modify, suspend, or discontinue features at any time. We may update these Terms; continued use after changes means you accept the updated Terms.

You can stop using Friendern at any time. We may suspend or terminate your access for any reason, including violations of these Terms. Certain sections (e.g., IP rights, disclaimers, limitations of liability, indemnity) survive termination.

Services are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.

To the maximum extent permitted by law, Friendern and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability to you will not exceed the greater of (a) USD $100 or (b) the amounts you paid to us in the 3 months before the claim.

You agree to defend, indemnify, and hold harmless Friendern from claims or losses arising out of your content, your use of the Services, or your breach of these Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria (without regard to conflict of law principles). Courts of Akwa Ibom State, Nigeria shall have exclusive jurisdiction. Where applicable law requires, disputes shall first attempt informal resolution via legal@friendern.app within 30 days.
